Judge Albert Northrop sentenced former University of Maryland student Arasp Biparva to no prison time and three years of probation for one count of manslaughter on Friday in a packed courtroom in Prince George’s County Circuit Court in Upper Marlboro, said John Erzen, a state’s attorney spokesman.

Biparva, 24, pleaded guilty last November to involuntary manslaughter in relation to the death of Jack Godfrey, a university student and Tau Kappa Epsilon fraternity member who died in November 2014.

The prosecution had asked for 10 years in prison with all but six years withheld, Erzen said. Under the three-year probation, Biparva will have to stay out of trouble or risk prison time if he is convicted of another crime, he added.

Northrop considered “whether or not there’s a need to send a message or use [this case] as a deterrent — the sentencing — and in this case he did not feel that that was appropriate,” Erzen said.

Biparva knocked Godfrey to the ground during an altercation outside of Cornerstone Grill and Loft on March 27, 2013. Godfrey suffered a concussion and head injuries from the incident, according to an April 2015 Diamondback article.

In December 2014 — about a month after TKE members found Godfrey dead in his bed — a medical examiner determined Godfrey’s death to be directly linked to injuries he sustained in 2013. Biparva was arrested and indicted on one charge of manslaughter in March 2015.

Prior to his sentencing, Biparva addressed the court, apologizing to Godfrey’s family and emphasizing the impact Godfrey’s death has had on his life.

Birparva “said that this is something that he carries with him everyday, and something that if he ever has children he’ll have to tell his children,” Erzen said. “He turned to the family and did say he was sorry for what he had done.”

John Godfrey, Godfrey’s father, wrote in an email that the family is “disgusted” by the judge’s decision.

“Three years probation for killing an innocent human being? That is embarrassing,” Godfrey wrote. “Judge Northrop told the world that my son’s life wasn’t worth anything. He is a disgrace.”
